No. 96-004 Association of Georgia ) ) v. ) ) BellSouth Telecommunications, Inc. ) ORDER Adopted: December 9, 1996 Released: December 10, 1996 By the Chief, Cable Services Bureau: 1.In this Order, we address a Motion for Enlargement of Time filed by Tennessee Cable Telecommunications Association ("TACA") and the Cable Television Association of Georgia ("CTAG") (the "Complainants") on November 22, 1996. The Complainants move for an enlargement of time to December 16, 1996 within which to file their Reply in this proceeding. As discussed below, we grant the Motion. 2.Pursuant to Section 1.46 (c) of the Commission's rules concerning extensions of time, the Complainants request that we extend the deadline for filing its reply in this proceeding from December 11, 1996 to December 16, 1996. The Complainants assert that good cause exists for granting the requested extension, that such extension is in the public interest, and is not opposed by Respondent. According to the Complainants, they are currently engaged in discussions with the Respondent which may result in informal resolution of some or all of the issues pending in this proceeding. The Complainants assert that the grant of this motion will serve the public interest because it will provide all parties with a fair opportunity to fully assess issues raised both in the Complaint, and in Respondent's Response, and, to continue to explore avenues for informal resolution. 3.Although it is the policy of the Commission that extensions of time shall not be routinely granted, we believe that the facts in this proceeding warrant granting the Complainants request. Given the current discussions between the parties, and the potential for informal resolution of some or all issues pending in this proceeding, we believe that granting the Complainant's motion and extending the deadline for filing its Reply until December 16, 1996 is appropriate and serves the public interest. 4.Accordingly, IT IS ORDERED, pursuant to Section 1.46 of the Commission's rules, that the Motion for An Enlargement of Time filed by Tennessee Cable Telecommunications, Association, et. al. and the Cable Television Association of Georgia, et. al., IS GRANTED. 5.This action is taken pursuant to delegated authority under Section 0.321 of the Commission's Rules, 47 C.F.R.
