On March 29, 1996, Falcon Cablevision ("Falcon"), franchisee in the above referenced proceeding, filed a petition for review of the local rate order, adopted February 12, 1996, by the City of Cedartown, Georgia ("Cedartown"). Cedartown filed an opposition to it on April 12, 1996, to which Falcon replied on April 24, 1996. Thereafter, Cedartown filed a motion to file an additional pleading and a motion to dismiss portions of Falcon's reply on June 6, 1996, and Falcon filed an opposition to the motion to dismiss on June 10, 1996. For the reasons stated below, Falcon's "Petition For Review Of Rate Order" is dismissed. 2. Under the Commission's rules, any participant in a ratemaking proceeding at the franchising authority level may file an appeal of the franchising authority's decision with the Commission within 30 days of the release of the text of the franchising authority's decision. Falcon did not file the instant petition until March 29, 1996, which, under the Commission's rules, was 16 days late. Therefore, it is untimely and must be dismissed. 3. Accordingly, IT IS ORDERED that the "Petition For Review Of Rate Order," filed March 29, 1996, by Falcon Cablevision, IS DISMISSED. 4.
