Rural Missouri Cable TV, Inc. ("Missouri Cable"), a cable operator serving Branson, Missouri, seeks to withdraw its petition for reconsideration filed with the Commission regarding the decision to grant The Vacation Channel ("TVC") mandatory carriage rights on Missouri Cable's system. GEP, Inc., licensee of low power television station K05JQ-TV, also filed to withdraw its petition for reconsideration of that decision. In the Order, we granted TVC's request for mandatory carriage on Missouri Cable's system on the grounds that Missouri Cable had not met its obligation to carry at least one qualified low power television station on its cable system as required by Section 614 of the Communications Act and the Commission's implementing rules. In reaching that decision, we determined that K05JQ-TV, which was currently being carried by Missouri Cable, had not demonstrated that it qualified as a low power station. 2. Missouri Cable states that it has reached an agreement with TVC which, inter alia,provides for TVC's continued carriage on its cable system serving Branson. As a result of its agreement, Missouri Cable states that further action by the Commission in this matter is not warranted. K05JQ-TV also states that it has reached an agreement with the parties which obviates the need for further action by the Commission on its petition for reconsideration. In light of their agreements, Missouri Cable and K05JQ-TV have each requested to withdraw its petition for reconsideration of the Order. 3. Accordingly, IT IS ORDERED that the request to withdraw its petition for reconsideration filed by Rural Missouri Cable TV, Inc., Branson, Missouri (CSR-4723-M) IS GRANTED and its petition for reconsideration IS WITHDRAWN. 4. II IS FURTHER ORDERED that the request to withdraw its petition for reconsideration filed by GEP, Inc., licensee of K05JQ-TV, (CSR-4723-M) IS GRANTED and its petition for reconsideration IS WITHDRAWN. 5. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by Sections 0.204 and 0.321 of the Commission's rules, 47 C.F.R.
