In this Order we dismiss complaints about the rate the above-captioned operator ("Operator") was charging for its cable programming services tier, CPST, in the community referenced above on the ground that the complaints concerns a rate that is outside the jurisdiction of the Federal Communication's Commission ("Commission"). Under the Communications Act, the Commission regulates the CPST rate of cable systems not subject to effective competition upon the filing of a valid complaint. Our review reveals that the complaints filed against the Operator, while asserting that it challenges the rate of the CPST, challenges only the basic service tier. Complaints regarding the basic service tier rate is subject to the jurisdiction of the local franchise authority, and therefore the complaints do not trigger the Commission's jurisdiction. 2. Accordingly, IT IS ORDERED, pursuant to Section 0.321 of the Commission's rules, 47 C.F.R.  0.321, that the complaints referenced herein against the rates for CPST charged by Operator in the franchise area referenced in the caption during the period under review, ARE DISMISSED.
