By this Order, we extend the time period for filing reply comments until March 2, 1998 and establish a surreply comment date of March 16, 1998. On October 17, 1997, the Commission adopted a Report and Order and Second Further Notice of Proposed Rulemaking in the above-captioned proceeding. The Second Further Notice sought comment on several issues, including the benefits or disadvantages of exclusive contracts in promoting a competitive environment, and whether there are circumstances where the Commission should adopt restrictions on exclusive contracts in order to further promote competition in the multi-dwelling unit ("MDU") marketplace. The Second Further Notice established January 22, 1998, as the deadline for filing reply comments. 2. On January 14, 1998, the Independent Cable & Telecommunications Association ("ICTA") and OpTel, Inc. ("OpTel") filed a joint motion requesting a 45-day extension of time to file reply comments in this docket. ICTA and OpTel state that after reviewing a number of comments filed in this docket, ICTA engaged the services of a leading expert to study current market conditions in the multichannel video programming distributor (MVPD) market and to comment on the short-term and long- term effects of exclusive contracts between various types of MVPDs. ICTA states that the study would unlikely be completed before early March 1998 and requests that the Commission extend the reply comment date to March 9, 1998. We grant the parties' joint motion as we believe the record would benefit from the economic analysis described and will grant an extension of the reply comment date to March 2, 1998. We will further provide an opportunity for parties to file surreply comments in response to the reply comments. Surreply comments will be due March 16, 1998. IT IS ORDERED, that the time for filing reply comments in the above-captioned proceeding IS EXTENDED to March 2, 1998, and surreply comments are due on March 16, 1998. 3.
