Here we consider requests to withdraw FCC Form 329 rate complaints ("complaints"). The Federal Communications Commission ("Commission") received letters from the local franchising authorities ("LFAs") for the above-referenced communities requesting that the Commission allow the LFAs to withdraw their complaints against the cable services programming tier ("CPST") rates charged by the above-referenced Operator ("Operator"). We will allow the withdrawal of the complaints, and our review of the resulting rate justifications will therefore be terminated. 2. Our records show that, in each community set forth above, the LFA was the only complainant that filed a valid complaint with the Commission. Under the Cable Television Consumer Protection and Competition Act of 1992, and our rules implementing it, the Commission must review CPST rates upon the filing of a valid complaint. The withdrawal of the only complaints against an operator's CPST rate in a community constitutes the termination of our jurisdiction to regulate those rates. 3. Accordingly, IT IS ORDERED, that the request to withdraw the FCC Form 329 rate complaints against the CPST rates charged by the Operator in the communities referenced above IS GRANTED, and the review of the resulting rate justification filings IS TERMINATED. 4.
