Wyandotte Cable System is being rebuilt with an expected completion date of June 1999 and at that time additional channel space will become available." Complaint, Exhibit B.  WPXD points out that on October 30,  x1998, a second letter explaining the Station's mandatory carriage rights was sent to Wyandotte. WPXD  S ( xnotes further that on November 4, 1998, Wyandotte responded with another refusal of carriage.)X  xPr ( xԍComplaint, Exhibit D. Wyandotte acknowledges that WPXD has been granted mustcarry status in Wyandotte,  xMichigan, and reiterates its offer to begin carriage of WPXD in June 1999, at "an extremely favorable channel location.") WPXD states that Wyandotte's second mandatory carriage refusal prompted the filing of the instant Complaint.  Sk( ` Z4.` ` WPXD affirms that it is a qualified local station entitled to mandatory carriage, and asserts  xthat, pursuant to Section 4 of the Cable Television Consumer Protection and Competition Act of 1992 and  S( xSection 76.56(b)(2) of the Commission's rules,@  xP'(ԍ47 C.F.R.  76(b)(2).@ local commercial broadcast stations are entitled to"~ ,l(l(,,"  x mandatory carriage rights on cable systems within the same market. It points out that Wyandotte currently  xhas 56 available, activated channels and as such is required to devote onethird of its channel capacity (or  x19 channels) to mustcarry channels. Noting that Wyandotte is currently only using 11 of its channels for  xbroadcast stations, WPXD argues that, under the Commission's must carry rules, Wyandotte's carriage  xrefusal alleging lack of channel space is not a valid reason not to carry the Station. Therefore, WPXD  xcontends, Wyandotte has ample room to accommodate the Station's mandatory carriage request. WPXD  xconcludes that Wyandotte's refusal is unjustified and requests the Commission to order Wyandotte to start  xcarrying the Station's signal on "either Channel 31 or another channel in the proximity of other local  Sh(broadcast stations."7 h xP(ԍComplaint at 5.7  S( DISCUSSION ă  S ( ` *5.` ` Based on the information in the record, we grant WPXD's Complaint. Wyandotte  xpresented nothing to dispute Paxson's representations concerning television station WPXD's must carry  xstatus or its ability to deliver a good signal to Wyandotte's principal headend serving the city of  xWyandotte. The record, however, contains correspondence between Wyandotte and WPXD, in which  x\Wyandotte acknowledges the Station's must carry status and offers to carry the signal of WPXD at a  S (future date. Therefore, our discussion is limited to the issue of lack of channel capacity.= " X xP( xzԍWe note, however, that under our rules, a station's failure to provide the requisite overtheair signal quality  x>to a cable system's principal headend will not foreclose its carriage if the station provides a cable operator with  xzspecialized equipment, at the station's expense, which will improve the station's signal to an acceptable quality at  zP(a cable system's principal headend. Must Carry Order at 2991. See also U.S.C.  534(h)(l)(B)(iii).=  S7( ` .6.` ` We reject Wyandotte's carriage objections based on lack of channel capacity. Section  x`614(b)(1)(B) of the Communications Act mandates that cable systems "with 12 or more usable activated  xchannels shall carry the signals of local commercial television stations, up to onethird of the aggregate  S( xnumber of usable activated channels of such system."D B xP(ԍ47 U.S.C.  534(b)(1)(B).D In the Must Carry Order, the Commission  xinterpreted Section 614(b)(1)(B) as creating a clear statutory right of carriage that is not qualified by the  xBfact that an existing service must be dropped to make room for mandatory carriage of a local station and  x`that the carriage right applies "notwithstanding the existence of prior agreements between cable operators  S( xand cable programming services."  zPE( xԍSee Must Carry Order at 2988, and Aerco Broadcasting Corp. vs. Cable TV of Greater San Juan, 13 FCC 11186 (CSB 1998). In fact, in the Must Carry Order, the Commission stated that "[w]ith  xrespect to conflicts between the carriage or channel positioning rights of a mustcarry station and prior  xagreements between cable operators and cable programming services, we find that the provisions of the  S;( x1992 Cable Act supersede any such contracts."G;,  zP#(ԍMust Carry Order at 2988.G The Commission further indicated that neither  xinconvenience, marketing problems, need for system configuration, or need to make technical changes  xexcept for a "compelling technical reason" was sufficient reason to deny a commercial station's "on  S( xchannel" positioning.:  zP'(ԍId. at 2988.: In this connection, we note that Wyandotte's correspondence pleads the existence"P ,l(l(,,"  x~of prior carriage obligations with other program providers and argues that deletion of existing service may  x\be an inconvenience to subscribers. We find that such circumstances do not constitute a "compelling  S( xttechnical reason" for not accommodating mandatory carriage of a qualified local television station.1 zP(ԍId.1 The  x record shows that Wyandotte has 56 activated channels. Accordingly, under the rules Wyandotte is  xjobligated to carry up to 19 local signals. Wyandotte's system currently carries only 11 local stations, and therefore has an obligation to carry up to 8 additional local channels, including WPXD.  S( ` 7.` ` Finally, concerning WPXD's channel positioning request, we find that it has properly  x$requested carriage on channel 31 on Wyandotte's cable system, the same channel number on which it is  xbroadcast overtheair.
