CSB-A-0308 AND TKR CABLE OF GREATER LOUISVILLE ) CSB-A-0397 ) CSB-A-0618 Motion to Withdraw Appeals of Local Rate Orders ) Setting Basic Service Rates Issued by the Jefferson ) County League of Cities Cable Commission ) ORDER Adopted: December 9, 1999 Released: December 10, 1999 By the Chief, Consumer Protection and Competition Division, Cable Services Bureau: 1. On November 22, 1999, InterMedia Partners of Kentucky, L.P. ("InterMedia"), successor-in- interest to TCI/TKR of Jefferson County, Inc., d/b/a TKR Cable of Greater Louisville ("TKR"), and the Jefferson County League of Cities Cable Commission ("League of Cities") jointly moved to terminate Commission review of three local rate orders. TKR filed appeals on May 24, 1996 and April 23, 1997 of two local rate orders, Order No. 96-2 adopted April 24, 1996 and Order No. 97-1 adopted March 24, 1997 by the League of Cities. On March 26, 1999, InterMedia filed an appeal of Order No.99-1 adopted by the League of Cities on February 24, 1999. TKR and InterMedia also filed Requests for Emergency Stay of each of the rate orders. The rate orders denied InterMedia's rate increase for basic cable service and required InterMedia to issue refunds to subscribers. In the Joint Motion, InterMedia and the League of Cities state that they have reached an acceptable resolution of these matters and further Commission review of the underlying dispute is no longer necessary. InterMedia and the League of Cities withdraw the two appeals and requests for stay filed by TKR and the appeal and stay request filed by InterMedia, and all subsequent filings related to these proceedings. 2. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate Orders filed by InterMedia Partners of Kentucky, L.P., successor-in-interest to TCI/TKR of Jefferson County, Inc., d/b/a TKR cable of Greater Louisville and the Jefferson County League of Cities Cable Commission IS GRANTED and the appeals and requests for stay filed by TKR and InterMedia's appeal and request for stay ARE DISMISSED. 3.
