On October 21, 1998 Jones Communications of New Mexico, Inc., d/b/a Comcast Communications of New Mexico ("Comcast"), formerly Cable TV Fund 12-BCD Venture d/b/a Jones Intercable, Inc. ("Jones"), filed an appeal of the local rate order adopted on September 21, 1998 by the City of Albuquerque, New Mexico ("the City"). Comcast also filed a Request for Emergency Stay. The local rate order required Comcast to reduce the rates charged for basic cable service and to issue refunds to subscribers. 2. On November 30, 1999 Comcast filed with the Commission a motion to withdraw its appeal. In its motion, Comcast states that it has now reached an acceptable resolution of this matter with the City and further Commission review of the underlying dispute is no longer necessary. Comcast requests that the filings in these proceedings be dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that Comcast's Motion to Withdraw Appeal of Local Rate Order IS GRANTED and the appeal and stay request ARE DISMISSED. 4.
