Marcus Cable Associates, LLC ("Marcus"), filed with the Commission on October 13, 1998 an appeal of local rate order No. 2444 adopted by the City of Fort Worth, Texas ("City"). Marcus also filed a Request for Emergency Stay on November 6, 1998. The local rate order established new regulated rates for equipment and installation and required Marcus to implement certain rate reductions. 2. On November 12, 1999 Marcus filed a Motion to Withdraw its appeal. In its motion, Marcus states that the parties have resolved this matter and that there is no longer any need to burden the Commission with a review of the underlying dispute in this case. Marcus request that the Appeal and Stay Request be dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeal of Local Rate order filed by Marcus IS GRANTED and the appeal and emergency stay request ARE DISMISSED. 4.
