At issue is the television advertising of "round games", such as Draw Poker, Low Ball Poker, and Texas Hold 'Em, where players place wagers against each other and not against any casino establishment. The parties contend that games of skill are involved and the promotion of such games on television does not violate the Commission's rules prohibiting lottery advertising.
