PETITION FILED SEEKING DECLARATORY RULING THAT CERTAIN RESTRICTIONS OF
A NEW YORK TOWNHOME ASSOCIATION ARE PREEMPTED BY THE COMMISSION'S
OVER-THE-AIR RECEPTION DEVICES RULES


      The Commission has received a Petition for Declaratory Ruling from Jordan E. Lourie asking
the Commission to determine whether a covenant in the Declaration of Covenants for Roxbury Run
Village Association of Roxbury, New York, that prohibits the installation of Direct Broadcast Satellite
Antennas, is preempted by Section 1.4000 of the Commission's rules.

      The Petition is available for public inspection in the Cable Services Bureau Public Reference
