PETITION SEEKING DECLARATORY RULING THAT INTERNET SERVICE PROVIDERS ARE
ENTITLED TO COMMERCIAL LEASED ACCESS TO CABLE FACILITIES UNDER SECTION
612 OF THE COMMUNICATIONS ACT OF 1934, AS AMENDED

     The Commission has received a Petition for Declaratory Ruling from Internet Ventures, Inc. ("IVI")
and its subsidiary, Internet On-Ramp, Inc. ("IOR"), asking the Commission to issue a ruling that Internet
service providers, such as IVI and IOR, are entitled to commercial leased access under Section 612 of the
Communications Act of 1934, as amended.  The Petition alleges that IOR has requested and been denied leased
access in Spokane, Washington by TCI of Washington, the holder of the Spokane Cable Communications
Franchise.

     For purposes of our ex parte rules, this proceeding will be considered as non-restricted pursuant to
Section 1.1206 of the Commission's rules ("Permit-but-disclose proceeding").

     Parties may file responses to the Petition on or before July 13, 1999 and replies on or before July 28,
1999.  Please place the case identifier, CSR-5407-L, on all filings.
