             PETITION FOR DECLARATORY RULING THAT 
      DIGITAL TELEVISION STATIONS HAVE MUST CARRY RIGHTS  
                           CSR 5562-Z

Guenter Marksteiner, permittee of Station WHDT-DT ("WHDT"), Channel 59, Stuart, Florida
requests a ruling that a new DTV-only television station which seeks carriage of only a single channel of video
programming is entitled to mandatory carriage of such programming, subject to other applicable existing
requirements of the Communications Act and Part 76 of the Commission's rules.

     For purposes of the Commission's ex parte rules, this proceeding will be considered as non-restricted
pursuant to Section 1.1206 ("permit-but-disclose proceeding").

Comments and oppositions to WHDT's petition must be filed by August 4, 2000.  Replies are due
August 18, 2000.  All filings should reference the case identifier assigned to this proceeding, CSR 5562-Z.
