Report No. CC-569 COMMON CARRIER ACTION April 7, 1994 PAS GRANTED FINAL AUTHORITY FOR HYBRID SEPARATE SYSTEM INTERNATIONAL COMMUNICATIONS SATELLITE The Commission has granted PanAmSat, L.P. (PAS), final authority to launch and operate its Pacific Ocean Region (POR) separate international satellite system (PAS-4). The Commission also authorized PAS to modify its original application by making technical modifications and changing the orbit position of its proposed satellite from 192 degrees W.L. to 191 degrees W.L. The Commission denied a petition by PACSTAR which asked the FCC to delay or condition the final authorization to ensure that PAS would satisfactorily coordinate PAS-4 with any satellite launched into PACSTAR's orbit position half a degree from PAS-4. The Commission said PAS's change in orbit positions will increase the orbital space between the two satellites by one degree thus making it more likely that PAS and PACSTAR will be able to coordinate the operation of the satellites. The Commission noted that in its Separate Systems decision it stated it would not delay licensing of U.S. separate international satellite systems pending international coordination under the international radio regulations. The Commission retains the right to require the repositioning of PAS-4 on 30-days' notice. The Commission noted that, in a separate order, it found that PAS met the financial and technical requirements for final authority to construct the satellite system.
