Report No. CC-575 COMMON CARRIER ACTION June 17, 1994 FCC ADOPTS CONSENT DECREE TERMINATING FORFEITURE ACTION AGAINST AT&T; AT&T TO CONTRIBUTE $464,000 TO U.S. TREASURY The Commission and AT&T have signed a Consent Decree which terminates an enforcement action against AT&T initiated by the Commission with a Notice of Apparent Liability for Forfeiture (NAL) issued in August 1993. In the NAL, the Commission found AT&T apparently liable for a forfeiture of $464,000 for offering enhanced services and abbreviated dialing access to its enhanced services from its so- called "Stand-Alone Public Enhanced Communications System" public telephones without complying with the rules and regulations adopted by the Commission in its Third Computer Inquiry or obtaining the necessary Commission waivers. Subsequent negotiations between AT&T and Common Carrier Bureau staff culminated in an agreement that resolves and terminates the forfeiture proceeding. Under the terms of the Consent Decree, AT&T has agreed to pay the full amount of the forfeiture, without admitting liability for the actions that formed the basis of the NAL, and has waived any rights it may have to seek judicial review or otherwise challenge the Commission's order adopting the Consent Decree. The payment will be a voluntary, non-tax-deductible contribution to the U.S. Treasury. The Commission's Order adopting the Consent Decree terminates the forfeiture action without any finding of liability on the part of AT&T.
