Report No. CC-576 COMMON CARRIER ACTION June 20, 1994 FCC AND PACTEL ENTER INTO A CONSENT DECREE REGARDING NONWIRELINE CELLULAR STATION AT SAN DIEGO, CA The FCC and PacTel Cellular have reached an agreement which would terminate the Commission's Notice of Apparent Liability (NAL) proceeding regarding PacTel's station KNKA236 in the Domestic Public Cellular Radio Telecommunications Service serving Market 18B, San Diego, CA. Under the terms of the Consent Decree, PacTel has agreed to make a voluntary payment totalling $34,000, and the Commission has agreed to terminate its investigation into the matters alleged in this proceeding. The Order adopting the Consent Decree states that although there were no substantial and material questions of fact regarding PacTel's basic qualifications to be a licensee, the Consent Decree does not affect the relevance of the facts to PacTel's renewal expectancy. PacTel was issued a NAL for violating the Communications Act and the Commission's rules for unauthorized operation of the station. Because PacTel voluntarily disclosed its unauthorized operation, the forfeiture amount was adjusted to $34,000. Action by the Commission June 13, 1994, by Order (FCC 94-161).
