DA 94-1394 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of the Application of ) ) THE SOUTHERN NEW ENGLAND TELEPHONE ) File No. W-P-C-6858 COMPANY ) ) For Authority pursuant to Section 214 ) of the Communications Act of 1934, as ) amended, to construct, operate, own, ) and maintain facilities to test a new ) technology for use in providing video ) dialtone service in specific areas in ) Connecticut. ) MEMORANDUM OPINION AND ORDER Adopted: December 5, 1994 Released: December 6, 1994 By the Chief, Common Carrier Bureau: 1. On November 18, 1994, the Commission adopted an order and authorization that conditionally granted the request of Southern New England Telephone (SNET) to extend and amend its existing Section 214 authorization to provide video dialtone (VDT) services on a trial basis. 2. On November 21, 1994, after the adoption of the SNET VDT order, but prior to its release, the National Cable Television Association, Inc. (NCTA) filed a motion to dismiss SNET's application. In its motion, NCTA argues that SNET's Section 214 application fails to comply with the Commission's VDT rules. NCTA adds that its motion supplements its previous filing in this proceeding. Because the Commission granted SNET's request prior to NCTA's motion, we find that NCTA's motion is moot. Thus, we dismiss NCTA's motion. 3. Accordingly, IT IS ORDERED, that pursuant to Sections 0.91 and 0.291 of the Commission's Rules, 47 C.F.R. 0.91 and 0.291, NCTA's Motion to Dismiss is DISMISSED.
