NEWSReport No. CC 95-70 COMMON CARRIER ACTION December 7, 1995 FCC AFFIRMS ITS 800 DATABASE RATE STRUCTURE ORDER The FCC affirmed its 800 Database Rate Structure Order, denying all petitions for reconsideration of the Order. In that Order, the FCC adopted rate structure and pricing rules for 800 database access services provided by local exchange carriers (LECs). The Commission required LECs to charge interexchange carriers (IXCs) a basic 800 database charge for each 800 database query and permitted them to provide related optional "vertical" features. With regard to the Commission's price cap rules, the Commission recognized that vertical features of 800 database service should be treated as "new" services. The Commission also held that, while basic 800 database service did not fit squarely within the definitions of either a "new" or "restructured" service, that the arguments favoring treating it as a restructured service where stronger. The Commission also concluded that, based on a record indicating a highly unusual set of circumstances, it was appropriate to permit the LECs to treat certain specified costs associated with investments for 800 database service as exogenous costs under price caps. The Commission finds that none of the petitions for reconsideration raise any issues that the Commission did not already address in the initial Order and therefore it denies them all.
