NEWSReport No. DC 96-8 ACTION IN DOCKET CASE February 7, 1996 COMMISSION APPROVES SETTLEMENT AGREEMENT FACILITATING NEW CELLULAR RADIO SERVICE FOR JEWELL, KANSAS (CC Docket No. 90-591) The Commission has approved the Joint Motion for Approval of Settlement Agreement filed by Thomas Domencich and the Committee for a Fair Lottery (CFL), Nancy Naleszkiewicz, and Robert Tyler, Trustee, thus facilitating the institution of new cellular radio service for the Jewell, Kansas rural service area. Previously, the Commission had granted Naleskiewicz's application for authority to construct and operate a cellular radio service system serving the Jewell, Kansas area. The CFL then filed various pleadings objecting to the proposed assignment of the construction permit from Naleskiewicz to the Trustee. Now the parties have entered into a settlement agreement specifying that the Trustee would pay the CFL $50,000.000 and the CFL would withdraw all of its pleadings. The Commission has found that the Joint Motion fully complies with the rules governing settlement agreements and has terminated the proceeding. Action by the Commission February 2, 1996, by Order (FCC 96-41). Chairman Hundt, Commissioners Quello, Barrett, Ness, and Chong. - FCC - News Media contact: Rochelle Cohen at (202) 418-0500.
