We received nine comments and seven reply comments from interested parties. Based on our review of the record, we are dismissing the waiver request without prejudice. In the petition, you request waiver of Section 68.312(b)(1)(i) requiring customer premises equipment (CPE) to maintain 5 megohms of dc resistance over the onhook voltage range from 0 to 100 volts to prevent an indication of a line fault at the local exchange carrier's central office and a consequent erroneous maintenance action by the telephone company. You request waiver of this Section in order to register as terminal equipment under Part 68 a device that maintains a dc resistance greater than 5 megohms over a range from 100 to 9.5 volts, but at 9.5 volts or less (offhook condition) draws approximately 2.5 milliamperes off the telephone line to illuminate a light emitting diode (LED) indicating a line in use status on a parallel telephone or any other terminating device connected to the same line. You contend that the light indicating a line in use would help to forestall interruptions of phone conversations or important data transmissions. A majority of commenters, including Nexus Applied Research, Inc., New York Telephone Company and New England Telephone Company (NYNEX), Southwestern Bell Telephone Company, Telesector Resources Group of the NYNEX Corporation, Telecommunications Industry Association, United and Central Telephone Companies and USWest, oppose your waiver request because they assert that your device would adversely affect the Automatic Loop Insulation Testing (ALIT) that local exchange carriers use to verify the integrity of outside plant. They contend that if equipment attached to the network were automatically switched to low resistance in order to activate an indicator light, ALIT and other testing equipment would register misleading results, generating false trouble reports at the central offices of the local exchange carriers. These commenters further argue that if several"(0*0*0*)" Commutrontype devices were attached to extensions of the same line, the drain of current would multiply and increase the number of false trouble reports. Only two commenters, BellSouth and Rummel Engineering, support your waiver request, although their support is qualified. BellSouth tentatively concludes that your device will not adversely affect its ALIT and supports waiver subject to later challenge should field experience indicate that the device harms its network. Rummel Engineering argues that allowing such waivers will enhance competition and facilitate the provision of new services. However, Rummel recommends that any lineinuse indicator draw no more than 1 milliampere from the telephone line, as opposed to the 2.5 milliamperes drawn by Commutron's device. Based on our review of the record and the protection of network standards that our Part 68 requirements are meant to ensure, we find that you have failed to respond to the critical assertion of several commenters that your device will cause telephone companies' ALIT systems to malfunction by identifying a false ringtrip condition, thereby triggering unnecessary maintenance actions. You have not refuted such assertion, providing neither design information nor test data to show that the operation of your device will not adversely impact the network. The record strongly indicates operation of your device will lead to precisely the kind of harm that Section 68.312(b)(1)(i) is designed to prevent. Thus, you have failed to demonstrate that a grant of waiver is in the public interest.
