On August 14, 1995, the Metropolitan Washington Airports Authority ("Metropolitan") filed a Request for Declaratory Ruling regarding the demarcation point at Washington Dulles International Airport ("Dulles"), determinable under Section 68.3(b)(2) of the Commission's Rules. The request asks the Commission to resolve a controversy between Metropolitan and GTE South Incorporated ("GTE") regarding location of the demarcation point. GTE filed an opposition to Metropolitan's request on September 8, 1996 and responsive pleadings were filed. 2. On April 29, 1996, Metropolitan filed a motion to dismiss its Request for Declaratory Ruling stating that Metropolitan and GTE have resolved their dispute over the demarcation point at Dulles. Thus, we find that the issues raised in the request and related pleadings are now moot. 3. Accordingly, IT IS ORDERED that the REQUEST FOR DECLARATORY RULING filed by Metropolitan Washington Airports Authority IS DISMISSED AS MOOT. 4. This action is taken pursuant to authority found in Sections 4(i) and 5(c) of the Communications Act of 1934, as amended, 47 U.S.C. 154(i) and 155(c), and authority delegated thereunder pursuant to Sections 0.91, 0.204 (a)-(b) and 0.291 of the Commission's Rules, 47 C.F.R. 0.91, 0.204(a)-(b) and 0.291.
