On December 22, 1998, Classic Telephone, Inc. (Classic) filed a motion to dismiss its October 24, 1997, petition for reconsideration of the Commission's Memorandum Opinion and Order in the above-captioned proceeding, Classic Telephone, Inc., Memorandum Opinion and Order, FCC 97-335, 12 FCC Rcd 15619 (1997) (Classic Enforcement Order). In that order, the Commission denied Classic's "Petition for Emergency Relief, Sanctions, and Investigation" regarding Classic's efforts to enter the local telephone market in Bogue and Hill City, Kansas (the Cities). Classic states in its motion that it has decided not to provide local telephone service in the Cities and will instead focus its telecommunications efforts in other markets. Consequently, Classic states, the reasons for seeking reconsideration of the Commission's actions are now moot. 2. We agree with Classic that the issues raised in its petition for reconsideration are now rendered moot by its decision not to enter the local telephone market in Bogue and Hill City, Kansas. Accordingly, we dismiss as moot Classic's October 1997 petition for reconsideration. Given Classic's decision not to provide local exchange service in Hill City and Bogue, we also dismiss as moot the "Petition for Clarification or Alternatively Petition for Reconsideration" of the Classic Enforcement Order filed on October 24, 1997, by the Cities. 3. Accordingly, IT IS ORDERED, pursuant to authority delegated under Sections 0.91 and 0.291 of the Commission's rules, 47 C.F.R. 0.91, 0.291, that the motion to dismiss filed by Classic Telephone, Inc. IS GRANTED. 4. IT IS FURTHER ORDERED, pursuant to authority delegated under Sections 0.91 and 0.291 of the Commission's rules, 47 C.F.R. 0.91, 0.291, that the petition for reconsideration of the Classic Enforcement Order, filed by Classic Telephone, Inc., and the petition for clarification or, alternatively, reconsideration of the Classic Enforcement Order, filed by the City of Bogue, Kansas and the City of Hill City, Kansas ARE DISMISSED. 5.
