No.73 ) No. 2810 ) ORDER Adopted: February 24, 2000 Released: February 24, 2000 By the Chief, Competitive Pricing Division, Common Carrier Bureau 1. On February 10, 2000, Southwestern Bell Telephone Company (SWBT) filed Transmittal No. 2807 to amend its Tariff F.C.C. No.73, Access Service, Section 25, Expanded Interconnection (EIC). In Transmittal No. 73, currently scheduled to become effective February 25, 2000, SWBT proposes to provide, on an individual care basis (ICB), five (5) specialized service arrangements to meet unique and specific requirements of Sprint Communications. Under this arrangement SWBT will provide one OC3c Sonet based Interconnection cross-connect from a Broadband Circuit Service channel to the Sprint collocation cage at five individual locations in Dallas, Texas. The service is scheduled to become the subject of a general tariff offering in June of 2000. No later than February 25, 2001, Sprint Communications shall be required to either terminate the service or convert the service to the available general tariff offering at the rates, terms and conditions provided thereunder. No petitions have been filed against this transmittal. 2. Transmittal Nos. 2807 and 2810 raise the same issues regarding rate levels, rate structures, and terms and conditions of virtual collocation services as those that are subject to the investigation of SWBT's interconnection service offering. Therefore, Transmittal Nos. 2807 and 2810 are suspended for one day and will be subject to the investigation initiated in the Virtual Collocation Phase I Order. Any rates proposed in this transmittal will be subject to an accounting order to facilitate any refunds that may later prove necessary. 3. Accordingly, IT IS ORDERED that, pursuant to Section 204(a) of the Communications Act of 1934, as amended, 47 U.S.C.  204(a), and the authority delegated pursuant to Sections 0.91 and 0.291 of the Commission's Rules, 47 C.F.R.  0.91, 0.291, the revisions to Southwestern Bell Telephone Company's Tariff F.C.C. No. 73, filed under Transmittal Nos. 2807 and 2810, ARE SUSPENDED for one day from the effective date and an investigation of the referenced transmittals is instituted and incorporated within CC Docket No. 94-97. 4. IT IS FURTHER ORDERED that the SOUTHWESTERN BELL TELEPHONE COMPANY SHALL FILE tariff revisions within five business days of the release date of this Order to reflect this suspension. 5. IT IS FURTHER ORDERED that, pursuant to Sections 4(i) and 204(a) of the Communications Act of 1934, as amended 47 U.S.C.  154(i) and 204(a), the SOUTHWESTERN BELL TELEPHONE COMPANY shall keep accurate account of all amounts received by reason of the rates that are subject of this investigation.
