$// Public Notice; Pacific and Nevada Bell Waiver of Price Cap Rules; DA 95-1281 //$ $/ Section 0.291 Delegated Authority /$ TRANSMITTED FOR FCC RECORD ONLY DA 95 -1281 June 8, 1995 PACIFIC BELL AND NEVADA BELL FILE PETITION FOR CLARIFICATION OR WAIVER OF PRICE CAP RULES Pleading Cycle Established Comments: June 16, 1995 Reply Comments: June 21, 1995 On June 5, 1995, Pacific Bell and Nevada Bell (the Pacific Companies) filed a petition for clarification or waiver of the requirements adopted in the LEC Performance Review First Report and Order. The Pacific Companies request that the Commission clarify that the modified local exchange carrier (LEC) price cap rules permit the Pacific Companies to elect a 5.3 percent productivity offset figure (or X-Factor), without any sharing of 1995 earnings, beginning January 1, 1995. In the alternative, the Pacific Companies request a waiver of the Commission's rules and Orders to make such an election. Interested parties may file comments on the petition filed by the Pacific Companies no later than June 16, 1995. Replies to the comments may be filed no later than June 21, 1995. An original and four copies of all comments and replies must be filed in accordance with Section 1.51(c) of the Commission's rules, 47 C.F.R.  1.51(c). In addition, one copy of each pleading must be filed with International Transcription Services, Inc., 2100 M Street, N.W. Suite 140, Washington, D.C. 20037, and one copy with the Chief, Tariff Division, Room 518, 1919 M Street, N.W., Washington, D.C. 20554. Finally, all comments and replies must be served personally, rather than mailed, because of the short pleading cycle established.
