DA 95-1329 PLEADING CYCLE ESTABLISHED FOR COMMENTS ON PETITIONS FOR RECONSIDERATION OF NYNEX'S USPP PLAN Released: June 14, 1995 On June 5, 1995, AT&T Corp. (AT&T) and Teleport Communications Group Inc. (Teleport) filed petitions seeking reconsideration of the Commission's order granting NYNEX Telephone Companies (NYNEX) a waiver of its rules. The order allows NYNEX to recover carrier common line revenues from interexchange carriers and to deaverage its transport interconnection charge by geographic zone. See In the Matter of the NYNEX Telephone Companies Petition for Waiver, Transition Plan to Preserve Universal Service in a Competitive Environment (NYNEX USPP Waiver Order), MO&O, FCC 95-185, released May 4, 1995. AT&T argues that this decision will undermine the development of even limited competition in the exchange access market. AT&T also argues that the Commission's reliance on the waiver process to provide this pricing flexibility will encourage other local exchange carriers to seek similar relief thereby diverting Commission resources. In addition, AT&T argues that NYNEX's ability to bill its carrier common line revenue shortfall to interexchange carriers is discriminatory. Teleport argues that there are no special circumstances that justify granting NYNEX a waiver. Teleport also argues that NYNEX does not require pricing flexibility to compete in this market. Teleport adds that the Commission should provide a reasoned explanation for granting NYNEX a waiver when it denied US West a virtually identical waiver. Oppositions to the Petitions must be filed by July 14, 1995, and Replies to an Opposition must be filed by July 31, 1995.
