PLEADING CYCLE ESTABLISHED FOR COMMENTS ON NYNEX PETITION FOR WAIVER OF SECTION 69.121 OF THE COMMISSION'S RULES TO PROVIDE CONNECTION CHARGE SUBELEMENTS TO CUSTOMERS OTHER THAN INTERCONNECTORS Released: July 14, 1995 On May 31, 1995, the NYNEX Telephone Companies (NYNEX) filed a petition for waiver of Section 69.121 of the Commission's Rules, 47 C.F.R.  69.121, to permit NYNEX to provide connection charge subelements to customers other than interconnectors. NYNEX submits that the Commission in its expanded interconnection orders determined that only interconnectors (a party establishing an interconnection node in a local exchange carrier's central office pursuant to expanded interconnection tariffs) are entitled to order and be billed for the cross-connection charge. NYNEX indicates that it has received requests from interexchange carriers for the ability to order, and be billed for, the cross-connect element (an office channel termination under the NYNEX tariff) to multiplexing nodes established by interconnectors for both special and switched access services. NYNEX states that interexchange carriers believe the waiver would simplify the process by which circuits are ordered and the reporting of maintenance issues to NYNEX. NYNEX states that it would coordinate the interconnection of their services with the transport services provided by the interconnector, a function that NYNEX states is currently performed by the interconnector. NYNEX would assess a discrete charge for the additional functions that NYNEX would assume. On June 12, 1995, Teleport Communications Group, Inc. (Teleport) filed an opposition to the NYNEX petition for waiver. Noting its pending complaint against NYNEX, Teleport Communications New York v. NYNEX Telephone Companies, E-95-4 (filed Dec. 20, 1994), Teleport asserts that NYNEX does not need a waiver of the Commission's rules to provide the alternative ordering and billing option. Interested parties should file comments on the petition by July 21, 1995, and reply comments by July 27, 1995, with the Secretary, FCC, 1919 M Street, N.W., Washington, D.C. 20554.
