(US West) filed a request for special permission to waive the cost support requirements of Section 61.38 of the Commission's rules, 47 C.F.R.  61.38. Specifically, US West requests special permission to file the tariff for its video dialtone market trial in Omaha, Nebraska, without the economic support material required by Section 61.38 of the Commission's rules. Although US West does not believe that Section 61.49 of the Commission's rules, 47 C.F.R.  61.49, has any applicability to the Omaha market trial tariff, US West also requests a waiver of Section 61.49 to the extent the Commission decides that it may apply. US West claims that waiver of Section 61.38 is necessary because the costs of the Omaha system -- whose request for purchase was released two-and-one-half years ago and whose Section 214 application was approved 19 months ago -- are far different than the costs of currently available video dialtone systems. US West maintains that conducting a market trial based on outdated cost structures that would not be repeated in future video dialtone deployments would provide only marginal utility. Interested parties may file comments on US West's petition no later than July 21, 1995. Due to the short time available to the Bureau between the filing date for comments and the effective date of the US West video dialtone tariff, which is August 1, 1995, the Bureau will not accept reply comments. An original and four copies of all comments and replies must be filed in accordance with Section 1.51(c) of the Commission's rules, 47 C.F.R.  1.51(c). Parties should also hand serve US West with a copy of their comments. In addition, one copy of each pleading must be filed with International Transcription Services (ITS), the Commission's duplicating contractor, at its office at 2100 M Street, N.W., Suite 140, Washington, D.C. 20037 and one copy must be hand served to the Chief, Tariff Division, Room 518, 1919 M Street, N.W., Washington, D.C. 20554.
