$// Public Notice; United/Central X-Factor; DA 95-1797 //$ $/ Section 0.291 Delegated Authority /$ TRANSMITTED FOR FCC RECORD ONLY DA 95-1797 August 14, 1995 UNITED AND CENTRAL TELEPHONE COMPANIES FILES PETITION FOR WAIVER OF PRICE CAP RULES Pleading Cycle Established COMMENTS: August 28, 1995 REPLY COMMENTS: September 5, 1995 On August 8, 1995, the United Telephone and Central Telephone Companies (United), filed a petition requesting that the Commission waive its Rules and Orders concerning price cap regulation for local exchange carriers (LECs), and most recently modified in the LEC Performance Review First Report and Order, "to permit United to discharge the 1995 sharing obligation in order to effect the incentives intended with the no sharing regime." United states that it "seeks the same relief, and seeks to impement that relief in the same manner as was ordered by the Common Carrier Bureau" in response to similar waiver petitions filed by other LECs. United states that despite its election of the no sharing option (5.3 percent productivity offset figure or X-Factor), it is still effectively subject to a sharing obligation for the last half of 1995. United notes that to the extent that it implements measures to achieve efficiencies in the second half of 1995, it would not realize the full benefits of those efficiencies. United further notes, that the benefits of those efficiencies would be reflected in the full year's earnings, and would correspondingly increase United's sharing obligations for 1995. United states that it seeks to give full effect to its election of the no sharing option and to eliminate the disincentives of sharing for 1995. Interested parties may file comments on the United/Central petition no later than August 28, 1995. Replies to the Comments may be filed no later than September 5, 1995. An original and four copies of all comments and replies must be filed in accordance with Section 1.51(c)of the Commission's Rules, 47 C.F.R.  1.51(c).
