$// PN,Pacific Bell Pet. for Waiver of Pt. 69 for VDT Service //$ $/ 47 CFR  69 Access Charges /$ FOR RECORD ONLY DA 95-1896 PLEADING CYCLE ESTABLISHED FOR COMMENTS ON PACIFIC BELL'S PETITION FOR WAIVER OF PART 69 RULES TO ESTABLISH RATE STRUCTURE FOR VIDEO DIALTONE SERVICE CCBPol 95-10 Released: August 31, 1995 On August 25, 1995, Pacific Bell (Pacific) filed a petition requesting an expedited waiver of certain provisions of the Commission's Part 69 rules in order to permit Pacific to establish a rate structure for video dialtone service in four regions of California. Pacific states that a waiver is necessary because a uniform rate structure is not prescribed for video dialtone service. Pacific proposes to establish recurring and non-recurring rate elements to be assessed to customer programmers. Pacific states that it currently does not plan to bill end user subscribers for any video dialtone rate elements. Pacific states that it intends the rate elements described in its petition to apply to the four areas for which Pacific has received Section 214 approval, as well as to any other area in Pacific's territory in which Pacific deploys its video dialtone network in the future. Specifically, Pacific seeks a waiver of Parts 69.110 and 69.112 to allow establishment of its proposed video dialtone rate structure. Pacific also seeks a waiver of Part 69.305(b) to allow Pacific to assign the video dialtone investment included in Cable and Wire Facilities Category 2 to the appropriate Part 69 element. In addition, Pacific requests a waiver of Part 69.307(c) to allow Pacific to assign the general support facilities used in the provision of video dialtone services to the appropriate Part 69 element. Interested parties should file comments on Pacific Bell's petition by September 30, 1995 and reply comments by October 15, 1995 with the Secretary, FCC, 1919 M Street, N.W., Washington, D.C. 20554.
