DA 95-2325 PLEADING CYCLE ESTABLISHED FOR COMMENTS ON PACIFIC BELL'S PETITION FOR WAIVERS TO IMPLEMENT RESALE COMPETITION IN CALIFORNIA CCBPol 95-21 Released: November 9, 1995 On November 3, 1995, Pacific Bell (Pacific) filed a petition seeking waivers of Part 69 of the Commission's rules. Pacific states that the requested waivers are necessitated by the California Public Utilities Commission's (CPUC) July 24, 1995 decision authorizing competition in the local exchange. Pacific states that the CPUC's decision opens the local exchange market to competition, allowing certificated carriers to resell Pacific's tariffed local exchange services to their end users. Specifically, Pacific requests a waiver of the rules regarding End User Common Line (EUCL) charges to permit Pacific to assess the charges on resellers that use Pacific's local exchange services to serve their end user customers, and to base the charge on the status of resellers' end user customers (residential, single-line business or multi-line business). Pacific states that this waiver is required because Pacific will not have a direct relationship with end user customers of resellers. Pacific states that the waiver will assure that EUCL charges will continue to be assessed upon Pacific's customer of record for the local exchange service (the reseller) in the same manner as they are today. Pacific also seeks a waiver of the Commission's 1985 Order regarding application of the charge for a change in presubscription, to allow Pacific to assess the presubscription (PIC) change charge upon the resellers. Pacific states that this waiver is necessary, as with the EUCL charge, because Pacific will not have a direct relationship with end user customers of resellers.
