Washington, D.C. 20554 DA 96-153 PLEADING CYCLE ESTABLISHED FOR COMMENTS ON ALLTEL'S PETITION FOR WAIVER OF OF THE COMMISSION'S RULES CCBPol 96-05 Released: February 8, 1996 On February 2, 1996, ALLTEL Telephone Services Corporation (ALLTEL) filed a petition seeking to waive certain provisions of the Commission's rules and applicable Commission orders in order to permit the direct assessment to resellers of ALLTEL's local exchange services of end user common line (EUCL), presubscription change (PIC) charges, and flat-rated carrier common line (CCL) access charges. ALLTEL seeks such relief in light of local competition initiatives underway in various states. Specifically, ALLTEL requests a waiver of the Part 69 Rules to permit recovery of the EUCL and PIC charges from carriers that purchase and resell ALLTEL's local exchange services rather than recovery of EUCL and PIC charges from the ultimate end user. ALLTEL states that under a local resale arrangement, ALLTEL will lose the retail relationship with the end user. ALLTEL also seeks a waiver of the Part 69 Rule to permit the assessment of a flat-rated CCL charge to the local exchange reseller. ALLTEL states that interexchange traffic on unbundled common lines will no longer transit ALLTEL's switches in a local exchange resale environment, and that consequently ALLTEL will not have a mechanism to recover those costs that were previously recovered from interexchange carriers through a per-minute CCL charge. Interested parties should file comments on ALLTEL's petition by February 20, 1996 and reply comments by February 27, 1996 with the Secretary, FCC, 1919 M Street, N.W., Washington, D.C. 20554.
