P  ` Unliketraditionalcircuitswitchedtelephoneservices,DSLtransportsinformationoverapacketswitcheddatanetwork.Dataisdividedintoseparatepackets,witheachpacket ! havingitsownuniqueidentificationanddestinationaddress.AdvancedServicesOrder,13FCC #! "  TheFCCrejectedUSWESTsprofferedconstructionoftheActbasedonnothingmorethanitsownipsedixit,anditproposednoalternativeinterpretationofthestatutorylanguageinplaceof p&!$ USWESTs.BecausetheFCCneverbotheredtoexplainwhyitbelieveditcouldstretch P(#&  telephoneexchangeserviceand exchangeaccesstocoverDSLservices,itisimpossibletoknowwhethertheAdvancedServicesOrderistheproductofrationalthinking,andimpossibleto ,`'* predictwhatrulestheFCCwillapplyinfuturecases.Ataminimum,theCourtshouldvacatetheAdvancedServicesOrderandremandittotheFCCformorereasonedconsideration. P 0P f  12  /    כ p  ` DSLdoesnotpermitanytoanyintercommunicationwithinalocalexchange.WhenanendusersignsupforDSL,theusermustalsospecifytheInternetserviceprovider(orotherparty)withwhomtheuserwantstoestablishitshighspeedconnection.OncetheDSLproviderestablishesapermanentvirtualconnectionbetweenthetwo,theenduserhasanalwayson,dedicated pipeconnectedexclusivelytotheotherparty.   1  f  13  /    כIftheotherpartyisanInternet   serviceprovider,itcan,inturn,routetrafficfromtheenduserspipeovertheInternet.ButthisroutingisdonebytheInternetserviceprovider,nottheDSLprovider;theendusersDSLpipealwaysremainspointedtoitslocallypredesignatedparty.TheendusercanasktheDSLprovidertoredirectitsdedicatedlinktoadifferentInternetserviceprovider,buttheendusercannotsimply dialupanyInternetserviceprovider(oranyotherDSLenduser)atwill,as 0 wouldbepossiblewithatrue,intercommunicating telephoneexchangeserviceunder47U.S.C.153(47)(A).  3 f  14  /    ׀Inotherwords,DSLservicesgenerallyinterconnectatasinglepoint  withinthelocalexchange,andpermitthecustomertocommunicatewiththeWorldWideWebonlythroughthissinglepoint.
