DA 01-261 Released: February 1, 2001 SBC NO LONGER REQUIRED TO REPORT KANSAS AND OKLAHOMA PERFORMANCE MEASUREMENTS RESULTS UNDER SBC/AMERITECH MERGER CONDITIONS In the SBC/Ameritech Merger Order, the Commission adopted a Carrier-to-Carrier Performance Plan ("Performance Plan") to facilitate oversight of SBC's market-opening progress. The Performance Plan, among other things, requires SBC to report monthly the results of 20 performance measurements for each of its states. The performance measurements depict SBC's service to competitive LECs in the areas of operations support systems, provisioning, maintenance, interconnection, local number portability, collocation, and billing timeliness. Under the SBC/Ameritech Merger Order, SBC's obligation to comply with the Performance Plan for a particular state extends until the earlier of (i) 36 months after the date it is first potentially obligated to make payments for a state or (ii) the first date the company is authorized to provide in-region, interLATA services in that state pursuant to 47 U.S.C. 271(d)(3). On January 19, 2001, the Commission approved SBC's application to provide in-region interLATA services in Kansas and Oklahoma, effective March 7, 2001. Accordingly, SBC's obligation to report Kansas and Oklahoma performance measurements results under the SBC/Ameritech Merger Order will be extinguished on March 7, 2001. SBC's final submission of its Kansas and Oklahoma Texas performance measurements results will occur on March 20, 2001, which will show SBC's performance for the entire month of February 2000 for these states.
