NEWS Report No. CI 96-4 COMPLIANCE AND INFORMATION ACTION December 24,1996 FCC ISSUES NOTICE OF MONETARY FORFEITURE OF $6,000 TO AMATEUR RADIO OPERATOR IN PHOENIX, ARIZONA The Compliance and Information Bureau (CIB), by delegated authority, issued a Notice of Monetary Forfeiture to Timothy Harold Hoffman for the willful violation of the Communications Act of 1934, as amended, and the Commission's rules. The violation resulted from Mr. Hoffman's operation of a radio transmitter on amateur radio service frequencies without a valid license, failure to allow inspection of the radio station by authorized FCC personnel, willful and malicious interference to radio communications of licensed stations, and operation on CB channel 36, 27.365 MHz, to transmit one-way communications and material to amuse or entertain. The amount of forfeiture for this violation is $6,000. The violations were discovered by agents from the Douglas Field Office on May 14 and 15, 1995. On June 26, 1995, the Douglas Field Office issued an Official Notice of Violation (NOV) to Mr. Hoffman. Mr. Hoffman responded to the NOV by letter dated July 5, 1995, in which he admitted he was responsible for the violations. By letter dated October 1, 1996, Mr. Hoffman requested a reduction or the elimination of the forfeiture. After carefully evaluating the information provided by Mr. Hoffman, the Bureau concluded that he had failed to adequately document his claim of inability to pay.
