The amendment corrects and modifies VITA's technical proposal. * * * * * COMSAT CORPORATION File No. 106-SAT-MISC-95 COMSAT Corporation, through its COMSAT Mobile Communications business unit, filed an application pursuant to Sections 503(c) and (d) and 504(c)(1) of the International Maritime Satellite Telecommunications Act of 1978, 47 U.S.C.  752(c), (d), 753(c)(1), and the Commission's Order in Participation by Comsat in a New Inmarsat Satellite System Designed to Provide Service to Handheld Communications Devices, 10 FCC Rcd 1061 (International Bureau 1995), to participate in Inmarsat's procurement of I-CO facilities. For purposes of this application, the procedural rules in Section 63.52 of the Commission's rules apply, 47 C.F.R.  63.52. This is a non-restricted proceeding and pursuant to 47 C.F.R.  1.1206(a), ex parte presentations are permitted provided they are disclosed. * * * * * Other Pleadings Petition for Declaratory Ruling File No. 107-SAT-MISC-95 DIRECTV, Inc. (DIRECTV) has filed a Petition for Declaratory Ruling asking the Commission to issue a ruling that AT&T Corp. is not authorized to use its Telstar 402R satellite to carry the direct-to-home (DTH) service of Tee-Comm Electronics, Inc., a Canadian company. DIRECTV asserts that such carriage is not permitted by AT&T's existing transborder authorization. It also argues that permitting Canadian DTH providers to serve the U.S. would be unfair because the Canadian market is closed to U.S. companies. * * * * * Motion to Apply the "Fresh Look" File No. 108-SAT-MISC-95 Doctrine to COMSAT PANAMSAT Corporation (PANAMSAT) has filed a motion, pursuant to Sections 201 and 205 of the Communications Act of 1934, as amended, 47 U.S.C.  201 and 205, to have the Commission apply its "fresh look" doctrine to Comsat's long-term contracts for telecommunications services connected to the public switched network (PSN). PANAMSAT states that COMSAT should be prohibited from entering into any new contracts for PSN services that extend beyond January 1, 1997, and COMSAT customers with contracts for PSN services should have at least one year, beginning January 1, 1997, to terminate those contracts without liability. - FCC -
