Washington, D.C. 20554 DA 97-1330 June 27, 1997 TEL ECOM FINLAND SEEKS DECLARATORY RULING UNDER SECTION 310(b)(4) TO PERMIT INDIRECT OWNERSHIP OF LMDS AND PCS LICENSES Fil e No. ISP-97-002 Telecom Finland has petitioned the Commission for a declaratory ruling, in advance of future Local Multipoint Distribution Service ("LMDS") and Personal Communications Service ("PCS") auctions, that granting Telecom Finland indirect ownership of LMDS and PCS licenses would serve the public interest. Telecom Finland states that it intends to own LMDS and PCS licenses through two U.S. subsidiaries, one which will own the license and the other which will own stock in the licensee. Telecom Finland argues that its request satisfies the effective competitive opportunities ("ECO") test because Finland's wireless and data telephony market is open to foreign participation, on a legal and factual basis, and Telecom Finland's many years of experience in providing PCS services will serve the public interest by promoting competition in the United States. Interested parties may file comments regarding this petition no later than July 28, 1997. Reply comments may be filed no later than August 11, 1997. All filings should refer to File No. ISP-97-002.
