   IN RE THE APPLICATION OF GLOBECAST NORTH AMERICA, INC., FOR
MODIFICATION OF EARTH STATION KA286 TO ADD EUTELSAT I-F5 AS A POINT
 OF COMMUNICATIONS AND TO REVISE THE ORBITAL ARC DATA TO ACCESS 
EUTELSAT I-F5 AT 12.5 DEGREES W.L. FOR THE PROVISION OF 
DIGITAL SERVICES, INCLUDING VIDEO, BETWEEN THE UNITED STATES AND
              FRANCE AND OTHER EUROPEAN COUNTRIES

     The proceeding captioned above is an adjudicative proceeding and is generally restricted
under the Commission's ex parte rules.  See 47 C.F.R.  1.1202(d) and 1.1208.  The filings in
this proceeding raise complex technical, legal and policy issues, and a regional satellite
organization, the European Telecommunications Satellite Organization ("EUTELSAT"), is a
party.  EUTELSAT seeks modification of the ex parte procedures in this proceeding to discuss
spectrum management, jurisdictional and competition issues related to the implementation of the
Commission's DISCO II framework.  Amendment of the Commission's Regulatory Policies to
Allow Non-U.S. Licensed Space Stations to Provide Domestic and International Service in the
United States, IB Docket No. 96-111, Report and Order, 12 FCC Rcd 24094 (1997).  Given the
interests of EUTELSAT and various European countries in this proceeding and the sensitivities of
communications between governments, we modify the ex parte procedures for this proceeding. 
The proceeding shall be treated on a non-restricted, permit-but-disclose basis.  47 C.F.R. 
1.1200(a), 1.1206 and 1.1208, Note 2.

     Accordingly, effective August 24, 1999, ex parte presentations relating to this proceeding
are subject to the disclosure requirements set forth in Section 1.1206 of the Commission's rules.

     This action is taken pursuant to authority found in Sections 4(i) and 303 of the
Communications Act of 1934, as amended, 47 U.S.C.  154(i) and 303; and pursuant to
Sections 0.51, 0.261 and 1.1200(a) of the Commission's Rules.
