Dominion Video Satellite, Inc. ("Dominion") has voluntarily withdrawn its request for assignment of direct broadcast satellite (DBS) channels at the 166§ W.L. orbital location. 2. On December 3, 1982, Dominion received a conditional permit to construct and operate a DBS system. CBS, Inc., Memorandum, Opinion, and Order, 92 FCC2d 64 (1982). On August 4, 1995, the International Bureau conditioned assignment to Dominion of eight DBS channels at a western location on submission of a request identifying specific channels among those available at either 166§ W.L. or 175§ W.L. Dominion Video Satellite, Inc., Memorandum, Opinion and Order, 10 FCC Rcd 10480 (Int'l Bureau 1995). The Bureau also conditioned an assignment of western channels on Dominion's submission of revised satellite construction information. Id. On September 6, 1995, Dominion requested assignment of eight DBS channels at the 166§ W.L. orbital location. Letter to Acting Secretary, FCC, from Robert W. On November 20, 1995, Dominion filed a request to exchange two of its western channels at 166§ W.L. for two eastern channels at 61.5§ W.L. Application of Dominion Video Satellite, Inc., File No: 16-SAT- MP-96 (Nov. 20, 1995). The International Bureau denied this request. Dominion Video Satellite, Inc., Order, 11 FCC Rcd 11510 (Int'l Bureau 1996). Dominion filed an Application for Review of the Bureau's Order. Application for Review, File No: 16-SAT-MP-96 (April 8, 1996). On August 21, 1998, Dominion requested dismissal of its Application for Review. On September 24, 1999, Dominion voluntarily withdrew its request for assignment of DBS channels at the 166§ W.L. orbital location in a letter to Donald Abelson, Chief, International Bureau, from Marvin Rosenberg, Counsel for Dominion Video Satellite, Inc. (September 24, 1999). Accordingly, Dominion's Application for Review is dismissed, and its construction permit for DBS channels at the 166§ W.L. orbital location is hereby cancelled.
