Report No. MM-821 MASS MEDIA ACTION April 28, 1994 EIGHT RADIO STATIONS IN UPSTATE NEW YORK GRANTED LICENSE RENEWALS, SUBJECT TO SANCTIONS INCLUDING SHORT-TERM RENEWAL, FORFEITURES & REPORTING CONDITIONS Following review of their respective EEO (Equal Employment Opportunity) programs, the Commission has granted, subject to sanctions and remedies, the license renewal applications to the following New York licensees: Beacon Broadcasting Corporation, for stations WBNR(AM)/WSPK(FM); Culver Broadcasting Corporation, Inc., for station WLVL(AM); Great Lakes Wireless Talking Machine Company, for station WZSH(FM); Eagle Broadcasting Company, for stations WHCU(AM)/WYXL(FM); and Historic Hudson Valley Radio, Inc., for stations WGHQ(AM)/WBPM(FM). The National Association for the Advancement of Colored People (NAACP) petitioned each application. The Commission has renewed the licenses of WBNR(AM)/WSPK(FM) subject to reporting conditions. The Commission said that based on its review of the record, it found that grant of the renewals would be in the public interest. It said that the licensee made efforts to recruit minorities and attracted and hired minority applicants during the license term. However, the licensee failed to self- assess its program adequately. Despite modification of its recruitment sources, the licensee of WBNR(AM)/WSPK(FM) failed to consistently use its minority-specific sources to attract minorities to its job pools. The Commission has renewed the license of WLVL(AM) subject to reporting conditions and a Notice of Apparent Liability (NAL) for $12,000. The sanctions are based on the licensee's failure to engage in recruiting efforts so as to attract an adequate pool of minority applicants for a substantial number of its seven full-time jobs. Further EEO conduct indicating a particular type of deficiency also contributed to the imposed sanctions. In this regard, the specific deficiency was the licensee's failure to recruit for at least a third of its positions. However, in evaluating the overall sanction, the Commission considered the size of the relevant minority labor force. (over) -2- The Commission has renewed the license of WZSH(FM) subject to reporting conditions. The Commission said that based on its review of the record, it found that grant of the renewal would be in the public interest. It said that the licensee made efforts to recruit minorities and attracted and hired minority applicants during the license term. However, reporting conditions are warranted to improve WZSH(FM)'s self-assessment and record-keeping. The Commission has renewed the licenses of WHCU(AM)/WYXL(FM) subject to reporting conditions and an NAL for $6,250. The sanctions are based on the licensee's failure to engage in recruiting efforts so as to attract an adequate pool of minority applicants for a substantial number of its 27 full-time jobs. Further EEO conduct indicating particular types of deficiencies also contributed to the imposed sanctions. In this regard, specific deficiencies include the licensee's failure to recruit for at least a third of its positions and inadequate efforts given the large number of hiring vacancies. However, in evaluating the overall sanction, the Commission did give the licensee credit for recruitment efforts which resulted in minority hires and job offers. The Commission also considered the licensee's minority employment record, as well as the size of the relevant minority labor force. The Commission has renewed the licenses of WGHQ(AM)/WBPM(FM) for a short term subject to reporting conditions and an NAL for $25,000. The sanctions are based on the licensee's failure to engage in recruiting efforts so as to attract an adequate pool of minority applicants for a substantial number of its 35 full-time jobs. Further EEO conduct indicating particular types of deficiencies also contributed to the imposed sanctions. In this regard, specific deficiencies include the licensee's failure to recruit for at least a third of its positions and inadequate efforts given the large number of hiring vacancies.
