         CANCELLATION OF CP FOR KTFJ(TV), HUTCHINSON, KS, UPHELD
        
     The Commission has denied the application of Way of the
Cross of Hutchinson, Inc., for review of a staff ruling denying
Way's application to replace its expired construction permit for
KTFJ(TV), Channel 36, Hutchinson, KS.

     On April 17, 1986, the Chief, Television Branch, cancelled
Way's CP for the station after the permittee allowed the permit
to expire and did not file a timely application to replace the
permit.  No petition for reconsideration was filed and the action
became final on May 18, 1986.
     
     More than five years later, on October 24, 1991, Way filed
an application to replace the expired permit.  That petition was
dismissed and a petition for reconsideration of the dismissal was
denied on June 29, 1992.

     In its review of the staff's actions, the Commission said
that Way merely reiterated arguments previously made and
rejected.  It concluded that the matter was fairly considered and
properly decided by the staff.

     Action by the Commission June 10, 1994, by Order (FCC 94-
153).  Chairman Hundt, Commissioners Quello and Barrett, with
Commissioners Ness and Chong not participating.
