Report No. MM-843 MASS MEDIA ACTION July 19, 1994 FCC CONSENTS TO ASSIGNMENT OF LICENSE OF WSNR-TV, SYRACUSE, NY; WAIVES ONE-TO-A-MARKET RULE The Commission has consented to assign the license of WSNR- TV, Ind., Channel 43, in Syracuse, NY, from Salt of the Earth Broadcasting, Ltd. (SEBC Ltd.), to Salt of the Earth Broadcasting Corp. (SEBC). Craig L. Fox, one of SEBC's principals, also controls Station WOLF(AM), in Syracuse, and also has an option to acquire control of SEBC. Because the common ownership of co- located television and radio stations falls under the prohibitions of the Commission's one-to-a-market rule, SEBC requested and was granted a waiver of the one-to-a-market rule. The Commission, using a case-by-case analysis, carefully reviewed SEBC's request for a waiver and the detailed showings submitted in support of that request. Based on these factors, the Commission concluded that SEBC has fully justified a permanent waiver of the one-to-a-market rule to permit common ownership of the AM-TV combination it proposes. SEBC documented substantial economic efficiencies which will result in increased programming responsive to community needs. Further, the Commission stated that the proposed combination will not create any undue concentration of ownership or control of the broadcast media in the Syracuse market. SEBC and its principals own no other media interest in the Syracuse market, and the stations have modest technical facilities. The Commission believes that SEBC has demonstrated levels of diversity and competition in Syracuse which allay substantially the concern the Commission might have over the common ownership of the facilities it proposes to control. Specifically, SEBC has shown an abundance of alternative media information sources in each market. In sum, the Commission believes that SEBC has shown that a waiver of the one-to-a-market rule is in the public interest.
