NEWSReport No. MM-846 MASS MEDIA ACTION September 1, 1994 FCC CONSENTS TO ASSIGN THE LICENSES OF THREE PUERTO RICO TV STATIONS TO INTERSTATE GENERAL PROPERTIES; AUTHORIZES SATELLITE OPERATIONS The Commission has granted the applications of Interstate General Properties Limited Partnership, S.E. (IGP) to acquire the licenses of television stations: 1) WSJN-TV, Channel 24/Ind., San Juan, PR, from JEM Communications, Inc.; 2) WKPV(TV), Channel 20/Ind., Ponce, PR, from Multi Media Television, Inc., which wholly owns JEM, subject to conditions; and, 3) WJWN-TV, Channel 38/Ind., San Sebastian, PR, from Tele 38, Inc. Although no contour overlap exists between the San Juan and San Sebastian stations, the predicted Grade B contours of the San Juan and Ponce stations overlap, as do the predicted Grade A contours of the Ponce and San Sebastian stations. The duopoly rule generally prohibits common ownership or control of television stations with overlapping Grade B contours. However, IGP requested and the Commission granted authorization to operate the Ponce and San Sebastian stations as satellites of the San Juan station, pursuant to the satellite exception to the duopoly rule. The Commission noted that all three stations have been dark since 1989, when Hurricane Hugo damaged them, and that IGP intends to return all three to the air. The Commission also recognized the substantial signal blockage caused by the island's mountainous terrain. Therefore, using its ad hoc satellite analysis, the Commission concluded that satellite operation of stations WKPV(TV), Ponce, and WJWN-TV, San Sebastian, is justified. However, because other full-service stations are licensed to Ponce, the Commission will require WKPV(TV) to establish a main studio and originate some local programming within 18 months of the commencement of operations.
