Report No. DC-2701 ACTION IN DOCKET CASE December 29, 1994 COMMISSION UPHOLDS DISMISSAL OF AVID COMMUNICATIONS' APPLICATION FOR NEW FM STATION AT TEMECULA, CA (MM DOCKET NO. 91-309) The Commission has denied Avid Communications, Inc.'s application for review of the Review Board's dismissal of its application for a new FM station on Channel 233A at Temecula, CA. The Administrative Law Judge in this proceeding denied Avid's application on comparative grounds in the Initial Decision and the Board granted a motion to dismiss Avid's application for failure to file exceptions to the adverse disposition. Seeking review, Avid contended that the Board had ignored equitable factors that would have justified a waiver of the filing deadline. Upholding the Board's decision, the Commission said that Avid had failed to show good cause for waiving the deadline and departing from the policy of dismissing applications denied in initial decisions when the applicants fail to file timely exceptions.
