NEWSReport No. MM 95-28 MASS MEDIA ACTION March 17, 1995 TELEVISION STATION KLDT ORDERED TO FORFEIT $15,500 FOR VIOLATION OF MAIN STUDIO, PUBLIC INSPECTION FILE, AND FILING RULES The Commission has ordered KLDT-TV 55, Inc., licensee of television station KLDT, Lake Dallas, TX, to forfeit $15,500 for willful and repeated violations of the Commission's main studio, public inspection file, and filing rules. The main studio rule requires each licensee to maintain a "meaningful management and staff presence" at its main studio location. In this case, KLDT's main studio was found improperly staffed based on four different visits to the station. On each of these occasions, those seeking access to the studio during normal business hours found it completely unattended. In addition, the public inspection file was missing several categories of items, and the licensee had failed to file with the Commission an agreement concerning ownership of the station. KLDT-TV argued that any violations were relatively minor, and that the $20,000 forfeiture originally proposed in the September 1, 1993, Notice of Apparent Liability was unjustified and would jeopardize station operations. The Commission rejected the licensee's arguments but reconsidered the forfeiture amount, since the $20,000 figure had been based on the Commission's forfeiture guidelines, which have since been set aside by the United States Court of Appeals. The Commission concluded that KLDT's main studio violation warranted a $7,500 forfeiture, that its several serious public inspection file omissions warranted a $4,000 forfeiture, and that its failure to file the agreement pertaining to ownership of the station warranted a $4,000 forfeiture. Thus, the total amount of the forfeiture assessed against KLDT was reduced to $15,500. Action by the Commission March 6, 1995, by Memorandum Opinion and Order (FCC 95-95).
