Report No. MM 95-49 MASS MEDIA ACTION June 26, 1995 FCC GRANTS PACIFIC FM, INC.'S REQUEST FOR WAIVER OF THE ONE-TO-A-MARKET RULE The Commission granted Pacific FM, Inc.'s request for waiver of the one-to-a- market rule and the subject assignment of KDIA (AM), Oakland, CA license application from 1310 Inc. Pacific FM, Inc.'s showing in support of a waiver of the one-to-a-market rule meets the Commission's case-by-case waiver standard, and a waiver in this instance is consistent with the public interest and would not have an adverse effect on diversity and competition in the San Francisco market. Pacific FM, Inc. has also shown that the proposed combination complies with the local radio ownership rules in all relevant respects. Pacific FM, Inc. had to file a request for waiver of the one-to-a-market rule because it also owns KOFY(AM), San Mateo, CA and UHF television station KOFY- TV, Channel 20, licensed to San Francisco, CA. KOFY-TV is affiliated with the new Warner Brothers Network. Due to the fact that the Grade A contour of KOFY- TV encompasses all of Oakland, CA, granting of the subject application requires waiver of the Commission's one-to-a-market rule. Additionally, the informal objection filed by Mr. Alfred Williamson raising allegations concerning other qualified minority buyers for the station has been withdrawn. Both Mr. Williamson and the parties have submitted affidavits demonstrating that withdrawal of the objection complies with 47 C.F.R. Section 73.3588.
