NEWSReport No. MM 95- 54 MASS MEDIA ACTION June 28, 1995 ALLOTMENT OF TV CHANNEL 24 TO ALBION, NE UPHELD The Commission has upheld a staff decision allotting television Channel 24 to Albion, NE. The allotment was sought by Citadel Communications Co., Inc. and opposed by Busse Broadcasting, Corp. Citadel Communications is the licensee of television station KCAN (TV), Channel 8, Albion, NE. In a separate proceeding, the staff substituted UHF Channel 18 for VHF Channel 8 at Albion, allotted VHF Channel 8 to Lincoln, and modified the Citadel Communications Station KCAN license to specify Lincoln as the community of license. That action was specifically conditioned on the pledge of Citadel Communications to file an application for Channel 18 in Albion and operate it as a satellite of Station KCAU and thereby maintain the availability of ABC Network service in Albion. Following this pledge, Citadel Communications filed an application for Channel 18 in Albion. However, Fant Broadcasting in Nebraska filed a competing application for the same channel allotment, proposing a full-service facility. In order to resolve the matter, Commission staff issued a Notice of Proposed Rule Making, proposing to add Channel 24 at Albion, NE and permitting Citadel Communications to amend its pending application for Channel 18 to specify operation on Channel 24. In response to the Notice, Busse Broadcasting, licensee of Station KOLN-TV, Channel 10, Lincoln, NE, filed comments in opposition to the proposed addition of Channel 24 to Albion. The Commission issued a Report and Order rejecting Busse's arguments. Busse Broadcasting Corp. then filed an Application for Review. The Commission found nothing in Busse's request for review to warrant changing its decision. Action by the Commission June 26, 1995, by Memorandum Opinion and Order (FCC 95- 265).
