NEWSReport No. MM 95-103 MASS MEDIA ACTION November 3, 1995 FCC GRANTS WAIVER OF ITS ONE-TO-A-MARKET RULE TO TRIBUNE SACRAMENTO RADIO, INC. FOR THE ASSIGNMENT OF LICENSE OF STATION KVOD(FM), DENVER, CO The FCC granted a waiver of its "one-to-a-market" rule to Tribune Sacramento Radio, Inc. (Tribune) and granted the application for assignment of license of station KVOD(FM), Denver, CO. This uncontested case involves a television/radio "one-to-a-market" waiver request that must be analyzed under the five-part "case-by-case" standard. Tribune is currently the licensee of an AM station, licensed to Aurora, Colorado, and a Class C FM station and an independent VHF television station, both licensed to Denver. Tribune is proposing to acquire a second FM station in the Denver market, which is licensed as a Class C1 facility but was recently granted a permit to improve to full Class C status. Tribune demonstrated that common ownership and joint operation of the stations will result in significant cost savings, which will be used to enhance KVOD(FM)'s programming and result in public service benefits. Additionally, because of the plethora of voices in the Denver market, the proposed combination will not result in undue concentration of ownership control. Accordingly, the addition of this second FM station to Tribune's existing operations would not appear, on balance, to adversely affect competition and diversity in the Denver market.
