Report No. MM 96-3 MASS MEDIA ACTION January 26, 1996 COMMISSION RESCINDS FORFEITURE TO DENNIS ELAM, TRUSTEE FOR BAKCOR BROADCASTING, INC., DEBTOR The Commission has rescinded a proposed forfeiture of $25,000 to Dennis Elam, Trustee in Bankruptcy for Bakcor Broadcasting,Inc. Debtor, former licensee of Stations KMND(AM)/KNFM(FM), Midland, TX. In issuing the notice of apparent liability, the Commission had found apparent violations of its EEO rule at he stations. In rescinding the forfeiture, the Commission observed that all of the noted EEO rule violations had occurred while Bakcor was licensee. Given the circumstances of the bankruptcy proceeding, the Commission concluded that requiring payment from Elam would punish innocent creditors of the former licensee and serve no public interest purpose.
