At the request of Louisiana Television Broadcasting ("LTBC"), licensee of station WBRZ, NTSC Channel 2, Baton Rouge, Louisiana, the Commission has before it the Notice of Proposed Rule Making, 14 FCC 17816 (1999), proposing the substitution of DTV Channel 13 for DTV Channel 42 for TV station WBRZ at Baton Rouge. WBRZ filed comments stating its intention to promptly implement the allotment change, if granted. After the record closed, Louisiana Television, L.L.C., successor-in-interest, filed comments stating its interest in pursuing the allotment of DTV Channel 13. No other comments were filed. 2. We believe the public interest would be served by substituting DTV Channel 13 for DTV Channel 42 since WBRZ has pledged to construct a full-powered DTV facility on DTV Channel 13 as opposed to a minimal facility during the transition if it is required to construct on DTV Channel 42. A full-powered facility would greatly increase the population served thereby enhancing viewer acceptance of DTV in the Baton Rouge, Louisiana, service area. 3. DTV Channel 13 can be allotted to Baton Rouge, Louisiana, as proposed, in compliance with the principle community coverage requirements of Section 73.625(a) at reference coordinates (30-17-49 N. and 91-11-40 W.). In addition, we find that this channel is acceptable under the 2 percent criterion for de minimis impact that is applied in evaluating requests for modification of initial DTV allotments under Section 73.623(c)(2) for Station WBRZ with the following specifications: DTV DTV power Antenna DTV Service State & City Channel (kW) HAAT (m) Pop. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective September 18, 2000, the DTV Table of Allotments, Section 73.622(b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Baton Rouge, Louisiana 13, *25, 34c, 45c, 46 5. IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, shall submit to the Commission a minor change application for a construction permit (FCC Form 301) specifying DTV Channel 13 in lieu of DTV Channel 42 for station WBRZ at Baton Rouge. 6.
